      Bergen County Prosecutor John L. Molinelli announced the arrest of JOSEPH LOPEZ of 436 Elm Street, Kearny, NJ, date of birth 12/1/67, who has been charged with one count of Vehicular Homicide, and Driving While Intoxicated (DWI) in connection with a serious motor vehicle accident that occurred on Wednesday, March 27, 2008 at 12:25 p.m. in Englewood.
      The charges came about as a result of an investigation conducted by members of the Bergen County Prosecutor’s Office Fatal Accident Investigation Unit, under the direction of Chief Joseph Macellaro and the Englewood Police Department, under the direction of Chief David Bowman.
      The investigation revealed that Lopez, who is employed by a company which cleans out portable toilets, was operating a 2007 Ford F350 Truck traveling in a construction site located adjacent to West Sheffield Road in Englewood. After cleaning out the second portable toilet, Lopez entered his Ford truck and traveled around the portable bathroom. He then backed up, in a northerly direction and passed a parked flatbed which was being unloaded. As Lopez was traveling in reverse, he ran over a construction worker at the site. The construction worker is identified as Peter Toulson of 324 Union Street, Hackensack, NJ, date of birth 7/11/46. Shortly after striking Toulson, Lopez stopped his vehicle after hearing several construction workers yelling after him indicating that there was a man laying injured on the ground in the path where the vehicle had traveled. Lopez then exited the truck and walked over to the location of Toulson’s body.
      Peter Toulson was pronounced dead by Doctor Schiebman of the Englewood Hospital Emergency Room via the responding paramedics as a result of severe head trauma sustained during the accident.
      During the course of the accident investigation, police detected an odor of marijuana on Lopez. He was charged with DWI and a blood sample was drawn for toxicology testing. Authorities await the results of the toxicology tests.
      Bail was set at $35,000.00 with no 10% option by Englewood Municipal Court Judge James Dow, Jr., J.M.C.
      Prosecutor Molinelli states that the defendant is presumed innocent until proven guilty beyond a reasonable doubt and would like to thank the Englewood Police Department for their cooperation.

      Bergen County Prosecutor John L. Molinelli announced the arrest of David A. Goldenberg, D.O.B. 05/18/1962, of 432 Golf Dr., Oceanside NY. Goldenberg was arrested on March 28, 2008, on charges of Unlawful Access of a Computer System / Network (2C:20-25b); Unlawful Access of Computer Data / Theft of Data (2C:20-25c); and Conducting an Illegal Wiretap (2A:156A-27).
      The arrest came about as a result of a joint investigation conducted by members of the Bergen County Prosecutor’s Office Computer Crimes Unit, under the direction of Chief Joseph Macellaro and members of the Paramus Police Department, under the direction of Deputy Chief Richard Cary.
      The arrest stemmed from an investigation concerning the following: The Paramus Police Department received a complaint from a Paramus based corporation known as Sapphire Marketing, who specializes in high-end audio/visual systems. Representatives of Sapphire reported that they were being suspiciously and consistently underbid for contracts by a competitor for whom David Goldenberg works. They expressed suspicion of corporate espionage. Based on anomalies that the complainant noticed within their computer network and more specifically their electronic mail (e-mail) system, they suspected that the company’s e-mail system had been compromised and that e-mail was being intercepted. The Paramus Police Department (a member of the Computer Crimes Task Force) and the Bergen County Prosecutor’s Office Computer Crimes Unit initiated an investigation.
      The investigation revealed that Mr. Goldenberg had engineered the passwords protecting several of the complainant’s e-mail accounts. For a period of time, Mr. Goldenberg was intercepting and reading e-mails that related to potential contracts. Mr. Goldenberg then established a free e-mail account that he had control over, and created an automatic forward of the victim’s e-mail so that they would be sent to him directly. This afforded Mr. Goldenberg advanced knowledge of Sapphire’s customers and bid prices, thus further affording him an opportunity to underbid Sapphire. Sapphire Marketing estimates the loss in revenue from Mr. Goldenberg’s actions to exceed one-million dollars. Mr. Goldenberg was arrested without incident on this date.
      Prosecutor Molinelli states that the defendant is presumed innocent until proven guilty beyond a reasonable doubt. Prosecutor Molinelli would like to thank the Paramus Police Department for their prompt action in this investigation and their continuing commitment to the Computer Crimes Task Force.

      Bergen County Prosecutor John L. Molinelli announced the arrest of Richard W. Baldwin, D.O.B. 02/02/1970 of 656 Sycamore Lane, North Brunswick, NJ, on March 28, 2008 at 2:20 pm, on charges of Attempted Sexual Assault (2C:5-1/2C:14-2c), Luring (2C:13-6), and Attempted Endangering the Welfare of a Child (2C:5-1/2C:24-4a).
      The arrest came about as a result of an investigation conducted by members of the Bergen County Prosecutor’s Office, Computer Crimes Unit, under the direction of Chief Joseph Macellaro.
      The arrest stemmed from an investigation concerning the following: Richard Baldwin engaged in conversations via the Internet, specifically chat and instant messaging, with what he believed was a 14-year-old girl. During the course of those conversations Baldwin initiated sexually explicit dialog. Baldwin requested to meet the presumed 14-year-old-girl for the purpose of engaging in sexual activity. He was arrested without incident at the prearranged meeting location.
      Prosecutor Molinelli urges anyone whose child spoke with online with screen name “rwb70nj@yahoo” to contact the Bergen County Prosecutor’s Office Computer Crimes Unit. Prosecutor Molinelli states that the defendant is presumed innocent until proven guilty beyond a reasonable doubt.
