VICTOR KWAK CHARGED WITH ASSAULT BY AUTO

Bergen County Prosecutor John L. Molinelli announced today the arrest of VICTOR KWAK, a 22 year old Rutherford, New Jersey man in connection with a drunk driving collision which resulted in serious bodily injury to a pedestrian, Sandra Munoz-Molina, a 28 year old Carlstadt, New Jersey woman. The charges are the result of an investigation conducted by members of the Bergen County Prosecutorís Office Fatal Accident Investigation Unit Investigation Unit (FAIU) under the direction of Chief Steven CUCCINIELLO and the East Rutherford Police Department under the direction of Chief Laurence MINDA.
On Thursday, August 22, 2013, at approximately 7:43 p.m., the East Rutherford Police Department received a report of a motor vehicle collision which had occurred on Railroad Avenue, between Everett Place and Boiling Springs Avenue in East Rutherford. Officers responding to the scene determined that Victor KWAK, who was operating a 2006 Lexus GS430, had left the roadway, struck a light post and a pole and then the pedestrian. As a result of the collision, the pedestrian, Ms. Munoz-Molina, was transported to Hackensack University Medical Center. At the medical center, it was determined that Ms. Munoz-Molina had suffered serious bodily injury. Officers at the scene made observations that led them to believe that KWAK was driving while intoxicated.
As a result of a cooperative investigation conducted by members of Bergen County Prosecutorís Office Fatal Accident Investigation Unit (FAIU) and the East Rutherford Police Department, it was determined that at approximately 7:43 p.m., on August 22, 2013, Victor KWAK was driving east on Railroad Avenue towards its intersection with Everett Place. At that time, KWAK lost control of his vehicle, struck the curb on the south side of the roadway and then crossed back northward and drove off the road onto the sidewalk on the north side. KWAKís Lexus then struck and knocked down a tree, a street light and a wooden utility pole. KWAK then drove into Ms. Munoz-Molina who was standing on the sidewalk. The collision was determined to have occurred within one thousand feet of St. Maryís High School in Rutherford, New Jersey. A blood sample was taken from KWAK, who appeared to be intoxicated at the time of the collision, and will be submitted for toxicological examination. Ms. Munoz-Molina, who suffered a serious head injury, remains at Hackensack University Medical Center in critical condition.
Victor KWAK was charged with one violation of N.J.S.A. 2C:12-1c3(A), Aggravated Assault by Auto while driving in violation of R.S. 39:4-50 (DWI) within 1000 feet of a school, a crime of the 2nd degree. The investigation is ongoing and KWAK was also issued numerous summonses for motor vehicle violations including Driving While Intoxicated and Reckless Driving. KWAK was remanded to the Bergen County Jail Annex in lieu of bail set at $75,000 with no 10% cash option by East Rutherford Municipal Court Judge George Savino. His first appearance in East Rutherford Municipal Court has been scheduled for 1:00 p.m. on September 4, 2013.
Prosecutor Molinelli states that these charges are merely accusations and that the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt. He also would like to thank the East Rutherford Police Department for their assistance in this investigation.

On August 23, 2013 at approximately 10:00 am, a male suspect stole a Fort Lee Police Department unmarked vehicle during the course of an investigation. After the suspect entered the police vehicle, he struck one officer and attempted to run over another. Shots were fired at the suspect but it is unknown at this time if he was injured. The vehicle was recovered in New York City at 125th Street and Riverside Drive. The officer's duty bag/back pack containing a police department-issued raid jacket and .45 Caliber ammunition were stolen from the vehicle. The suspect should be considered armed and dangerous.

Bergen County Prosecutor John L. Molinelli announced the arrest of ANTHONY YACHOUH (DOB:: 8/2/90) of 475 Kossuth Street, Paramus, New Jersey on charges of Sexual Assault and Endangering the Welfare of a Child. The arrest is the result of an investigation conducted by members of the Bergen County Prosecutor's Office Special Victims Unit under the direction of Chief Steven CUCCINIELLO and the Paramus Police Department under the direction of Chief Kenneth EHRENBERG.
On August 22, 2013, members of the Bergen County Prosecutor's Office Special Victims Unit and the Paramus Police Department arrested Anthony YACHOUH after learning that he engaged in inappropriate sexual activity with an eight (8) year old female acquaintance. The Division of Child Protection and Permanency (DCP&P) were the first to become aware of the alleged abuse and subsequently notified the Special Victims Unit. The incident is alleged to have occurred about two years ago when the victim was 5 or 6 years old but only just reported. An investigation ensued resulting in the arrest of YACHOUH on August 22, 2013.
Anthony YACHOUH was charged with one (1) count of Sexual Assault and one (1) count of Endangering the Welfare of a Child.
Bail for Anthony YACHOUH was set by the Honorable Liliana DeAvila-Silebi, P.J.S.C., at $100,000.00 with no ten percent option and no contact with the victim. Mr. YACHOUH was subsequently remanded to the Bergen County Jail in lieu of bail.
