“Regarding Firearms Procedure after LE Response to Mental Health Issue” This Directive requires action to be taken whenever a Bergen County law enforcement agency receives information or a warning from any source related to a threat of imminent, serious physical violence to self or others made by an individual suspected of suffering from a mental illness.
“Regarding Criminal Investigations of Law Enforcement Officers and Public Employees” This directive requires that whenever a law enforcement officer or public employee becomes the subject of a criminal investigation, the law enforcement agency conducting the investigation must immediately notify the Bergen County Prosecutor’s Office Confidential Investigations Unit.
“Regarding Duty to Warn under the Mental Health Professionals’ Duty to Warn ACT” This Directive requires mental health professionals to notify local law enforcement when a patient has communicated a threat of imminent, serious physical violence or whenever a reasonable mental health practitioner believes that a patient intends to carry out an act of imminent, serious physical violence.
“Regarding Viewing Tagged Body Worn Camera Recordings” On July 28, 2015, New Jersey Acting Attorney General John J. Hoffman issued Law Enforcement Directive 2015-1 Regarding Police Body Worn Cameras (“BWCs”) and Stored BWC Recordings (“AG Directive”). The AG Directive, which is attached, sets forth statewide standards for the deployment and use of BWCs and recordings. This Directive is in response to a request by a Chief of Police to access “tagged” portions of BWC recordings.
“Regarding Small-Unmanned Aircraft Systems (sUAS)” The deployment of small-unmanned aircraft systems (sUAS), commonly referred to as “drones,” has become more commonplace, especially by law enforcement. These systems offer strategic and tactical insight into on-going critical events that may assist in reducing injuries or death to those involved, and provide for more efficient handling of a variety of situations. However, as with any technology, it is imperative that agencies employing such systems have a formalized protocol for the proper use and prevention of misuse. This Directive provides that protocol.
