Bergen County Prosecutor Mark Musella announced the arrest of ANDY PENA (DOB: 2/04/1981; single; truck driver) of 4 Ferndale Court, Lodi, NJ on charges of arson, aggravated arson, possession of a weapon and attempt to cause widespread injury or damage. The arrest is the result of an investigation conducted by the Bergen County Prosecutor’s Office under the direction of Chief Jason Love, and the Lodi Police Department under the direction of Chief Donald Scorzetti.

On Monday, July 19, 2022, the Lodi Police Department received information from a local establishment regarding suspicious fire damage on their exterior roof. First responders arrived on scene and observed approximately three large, burned areas on the roof along with several broken glass bottles.

The ensuing investigation revealed that, in the early morning hours of July 8, 2022, ANDY PENA intentionally set the fire by using glass bottles as hand-thrown incendiary weapons, causing fire damage to the roof of a commercial establishment.

On Thursday, July 28, 2022, ANDY PENA was arrested and charged with second-degree aggravated arson, N.J.S.A. 2C:17-1a(2); second-degree attempt to cause widespread injury or damage, N.J.S.A. 2C:17-2a(1)/5-1; third-degree arson, N.J.S.A. 2C:17-1b(2); and third-degree possession of a weapon, N.J.S.A. 2C:39-3a. He was remanded to the Bergen County Jail pending his first appearance in Central Judicial Processing Court in Hackensack, NJ.

Prosecutor Musella states that the charges are merely accusations and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt, and would also like to thank the Lodi Police Department for their assistance in this investigation.
