The Bergen County Prosecutor's Office has established a pilot diversionary program for individuals with mental disorders who are charged with third or fourth-degree crimes, and there is a nexus between the person’s mental disorder and the commission of the alleged crime as determined by a licensed mental health professional. Per N.J.S.A. 2C:43-33, a mental disorder means a serious mental disorder, other than a personality disorder, classified within the current version of the American Psychiatric Association Diagnostic and Statistical Manual of Mental Disorders (DSM), including, but not limited to, psychotic disorder, bipolar disorder, major depressive disorder, post-traumatic stress disorder (PTSD), and cooccurring substance use disorders. Crimes of violence (including the threat of violence) and offenses of the second degree or higher are presumptively ineligible. The goal is to divert appropriate individuals into supervised mental health services and case management and supervise their compliance over a period of time to seek an amendment of their charges or sentence. The BCPO shall have the sole discretion to determine if an applicant qualifies for the Program pursuant to N.J.S.A. 2C:43-37.
