Acting Bergen County Prosecutor Gurbir S. Grewal announced today upgraded charges related to the assault of a 64-year-old North Haledon resident, which occurred in Fair Lawn, New Jersey, on Friday, September 23, 2016.
As a result of an investigation conducted by the Bergen County Prosecutor’s Office, Major Crimes Unit under the direction of Officer-in-Charge, Deputy Chief Robert ANZILOTTI and the Fair Lawn Police Department under the direction of Chief Glen CAUWELS, STEVEN DUCKACK (DOB: 7/14/1957), of 13 Smith Avenue, Fair Lawn was arrested on September 28, 2016 at his residence and charged with assaulting the male victim. At that time, DUCKACK was charged with Aggravated Assault in the Second Degree, in violation of N.J.S.A. 2C: 12-1b(1), and was remanded to the Bergen County Jail for default of required bail in the amount of $250,000.00 with no ten percent option.
DUCKACK’s victim, however, succumbed to his injuries and died on Tuesday, October 4, 2016. As a result, the charges against DUCKACK have been upgraded to Manslaughter in the Second Degree, in violation of N.J.S.A. 2C11-4b.
A first appearance for DUCKACK on the most recent charges has been scheduled for Friday, October 7, 2016 at 1:30 p.m., in front of the Honorable James Guida J.S.C., at which time his bail will continue at $250,000.00 with no ten percent option. As a condition of his bail he is required to surrender his passport and is not permitted to possess firearms.
Acting Bergen County Prosecutor Grewal states that these charges are merely accusations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt and would like to thank the Fair Lawn Police Department for their assistance in this investigation.
