ZACHARY A. SMITH OF ELMWOOD PARK CHARGED WITH POSSESSION & DISTRIBUTION OF CHILD PORNOGRAPHY

Bergen County Prosecutor Gurbir S. Grewal announced the arrest of ZACHARY A. SMITH (DOB: 5/27/1992; single; and employed as a substitute teacher) of 113 Donor Avenue, Elmwood Park, New Jersey, on charges of Endangering the Welfare of a Child, specifically by possessing and distributing videos depicting child sexual exploitation. The arrest is the result of an investigation conducted by members of the Bergen County Prosecutor's Office ("BCPO") Cyber Crimes Unit under the direction of Chief of Detectives Robert ANZILOTTI. 

On Tuesday, November 29, 2016, members of the BCPO Cyber Crimes Unit, with assistance from members of the BCPO Cyber Crimes Task Force, executed a search warrant at the home of Zachary A. SMITH as the result of a month-long investigation relating to videos of child pornography on the Internet. Items of evidence were seized from the premises and the investigation revealed that SMITH utilized the Internet to access, view, and share sexually explicit videos of prepubescent and pubescent females.

As a result, Zachary A. SMITH was arrested and charged with violating one count of Endangering the Welfare of a Child, to wit: Possession of Child Pornography, N.J.S.A. 2C:24-4B(5)(B), a third degree crime, and one count of Endangering the Welfare of a Child, to wit: Distribution of Child Pornography, N.J.S.A. 2C:24-4B(5)(A), a second degree crime. The Honorable James J. Guida, J.S.C. of Bergen County set bail at $75,000.00 with no ten percent option. As conditions of bail, SMITH is to have no unsupervised contact with children, no Internet access unless for religious or work reasons, and he must surrender his passport. In lieu of bail, SMITH was lodged in the Bergen County Jail. SMITH is scheduled to appear in Bergen County Central Judicial Processing Court for a first appearance on Wednesday, December 7, 2016 at 8:30 a.m.

Bergen County Prosecutor Grewal states that this charge is merely an accusation and that the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt. Prosecutor Grewal would like to thank the municipal police agencies that comprise the BCPO Cyber Crimes Task Force, and specifically the following agencies, which were instrumental in this investigation: Bogota Police Department, Oradell Police Department, Ridgewood Police Department, and the Ramsey Police Department. In addition, Prosecutor Grewal would like to thank the Elmwood Park Police Department for their assistance in this investigation.
