LYDIA RATCHINSKY OF MOONACHIE, NJ CHARGED WITH MISAPPLICATION OF ENTRUSTED PROPERTY
Bergen County Prosecutor Gurbir S. GREWAL announced the arrest of LYDIA RATCHINSKY (DOB: 10/05/1968; single; employed as an airport construction security escort) of 2 West 2nd Street, Moonachie, NJ, on a charge of Misapplication of Entrusted Property. The arrest is the result of an investigation conducted by members of the Bergen County Prosecutor's Office, Financial Crimes Unit, under the direction of Chief Robert ANZILOTTI.
In December 2016, the Bergen County Prosecutor’s Office received a complaint that LYDIA RATCHINSKY, while acting as a fiduciary and executrix of her mother’s will, failed to maintain and provide the stipulated death benefits left to two of the heirs.
An investigation conducted by members of the Bergen County Prosecutor’s Office Financial Crimes Unit revealed that in 2014 the estate entrusted to Ms. RATCHINSKY was valued at over $400,000. The estate was to be equally distributed to numerous heirs; two of whom were to receive their funds upon reaching the age of twenty-one. In 2016, when one of the remaining shares of the will was to be distributed, it was determined that there were insufficient funds in the account which held the trust. An audit of the trust account revealed that in excess of $75,000.00 had been removed and utilized by Ms. RATCHINSKY in violation of her duties as a fiduciary.
As a result of the investigation, LYDIA RATCHINSKY was arrested on Monday, February 6, 2017 in Paramus, NJ and charged with one count of Misapplication of Entrusted Property, in violation of N.J.S.A. 2C:21-15, a 2nd degree crime. Ms. RATCHINSKY is scheduled to appear in Bergen County Central Judicial Processing Court for a first appearance on Wednesday, February 22, 2017 at 8:30 a.m.
Bergen County Prosecutor Grewal states that this charge is merely an accusation and that the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
