Bergen County Prosecutor Gurbir S. Grewal announced the arrests of KEVIN MARSH (DOB: 7/6/1978; married; and unemployed) of 107 South Cherry Street, Poughkeepsie, New York, DALE SMART (DOB: 1/21/1979; single; and unemployed) of 106 South Cherry Street, Poughkeepsie, New York, and SASHAGAYE BROWN (DOB: 10/16/1986; single; and unemployed) of 623 East 26th Street, Apt. 2, Paterson, New Jersey on drug charges. The arrests are the result of a joint investigation conducted by members of the Bergen County Prosecutor's Office under the direction of Chief Robert Anzilotti and the Hackensack Police Department under the direction of Officer in Charge Captain Francesco Aquila.
During December 2017, the Bergen County Prosecutor’s Office received information that Sashagaye BROWN was distributing large quantities of marijuana in the Bergen County area. On Friday, December 8, 2017, while conducting surveillance, law enforcement personnel observed BROWN meet with Kevin MARSH and Dale SMART in Hackensack, New Jersey. An investigative motor vehicle stop was conducted, in which SMART, MARSH, BROWN, and a female juvenile under BROWN’s care were present in the vehicle. During a search of the vehicle, twelve pounds of marijuana were located and seized from the trunk. The defendants were placed under arrest without incident and transported to the Bergen County Prosecutor’s Office for arrest processing. The female juvenile was transported to the Bergen County Prosecutor’s Office and later turned over to her mother.
Kevin MARSH and Dale SMART were each charged with one count of Possession with the Intent to Distribute Marijuana over 5 lbs. but less than 25 lbs., N.J.S.A. 2C:35-5B(10)(B), a 2nd degree crime. Sashagaye BROWN was charged with one count of Possession with the Intent to Distribute Marijuana over 5 lbs. but less than 25 lbs., N.J.S.A. 2C:35-5B(10)(B), a 2nd degree crime; and one count of Child Endangerment, N.J.S.A. 2C:24-4A(2), a 2nd degree crime. MARSH, SMART, and BROWN were released on summonses pending their first appearance court dates on Wednesday, December 27, 2017 at Central Judicial Processing.
Prosecutor Grewal states that the charges are merely accusations and that the defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt, and would also like to thank the Hackensack Police Department for their assistance in this investigation.
