Bergen County Prosecutor Gurbir S. Grewal announced the arrest of BENJAMIN C. SCARPULLA (DOB: 11/06/1996; single; and employed as a welder) of 3 Golf Avenue, Maywood, New Jersey on a charge of Assault by Auto. The arrest is the result of an investigation conducted by members of the Maywood Police Department under the direction of Chief David Pegg, the Bergen County Sheriff’s Office under the direction of Sheriff Michael Saudino, and the Bergen County Prosecutor's Office Fatal Accident Investigation Unit under the direction of Chief Robert Anzilotti.
On Wednesday, January 3, 2018 at approximately 2:34 a.m., the Maywood Police Department received multiple reports of a motor vehicle collision on Maywood Avenue, near its intersection with Lenox Avenue, in Maywood, NJ. Upon responding to the scene, officers located a 2009 Toyota Yaris with significant front-end damage. SCARPULLA, who was trapped in the driver’s seat, was removed from the vehicle by members of the Maywood Fire Department, and transported to Hackensack University Medical Center, where he was treated for minor injuries and released. A front-seat passenger was transported to Hackensack University Medical Center where he is currently in critical but stable condition.
As a result of the investigation, Benjamin SCARPULLA was arrested and charged with one count of Assault by Auto, N.J.S.A 2C:12-1c(3a), a second degree crime. SCARPULLA is scheduled for a first appearance in Bergen County Central Judicial Processing Court on Friday, January 12, 2018 at 8:30 a.m. SCARPULLA was also issued motor vehicle summonses for Driving While Intoxicated, in violation of N.J.S.A. 39:4-50 and Reckless Driving, in violation of N.J.S.A. 39:4-96.
Prosecutor Grewal states that these charges are merely accusations, and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt, and would like to thank the Maywood Police Department and the Bergen County Sheriff’s Office for their assistance in this investigation.
